Our lease lawyers Morayfield and Hendra will assist you in negotiating the terms of your lease to your advantage. We further advise on such issues as your rights and obligations under the lease, the costs associated with the lease and whether you wish to pay for registration of the lease and the mortgagee’s consent for further insurance. In drafting your lease we can protect your rights in a range of aspects including:

  • Stamp duty assessments
  • Assignment of leases and sub-leases
  • Exercise of options to renew
  • Rent reviews
  • Personal guarantees and other securities
  • Insurance requirements
  • Options to purchase

Our fixed fee prices:

New Commercial Lease if we draft lease 
$1,295* + GST (including $47.97 title search and sundries but excluding other searches) + any surrender of old lease ($595 + GST if tenant co-operates)+ any titles office registration fee ** (optional but recommended) + any Mortgagee Consent fee*** (optional but recommended).
New Retail Shop Lease if we draft lease
$1,495* + GST (including extra Disclosure Statement) and otherwise as set out above and below.
New Lease or Assignment of Lease advice if acting for Lessee
$495 incl. GST/hr for advice. Usually one hour or otherwise two (if Woolworths sized shopping centre lease) or up to double if errors, complications or negotiating amendments.
Assignment of Lease if acting for Lessor (paid by Lessee)
$1,595 + GST*
Extension of Lease if acting for Lessor
$1,095* + GST (or $1,295 + GST if Retail Shop Lease Disclosure Statement needed) if no updated mortgagee consent or bank guarantee needed.

* There is also an additional professional fee if we are required to arrange and execute bank guarantee documents or to obtain financial information from a new tenant or to sort out any fitout issues at $495/hr incl. GST for each of these optional requirements presuming we’re not involved in negotiations with the other party and both parties are co-operative and contactable at crucial times. (That is, not travelling).

** At least $231.98 registration fees + $43.56 if survey plan required (x 2  if extra title deeds are covered by lease) + surveyor’s fees if no survey plan available ($N/K) + our professional fees of $195+GST  if you arrange the survey plan

*** Usually $195+GST professional fee + $50-$400 depending on the financier.
